Terms & Conditions
Please read these terms carefully before using our services.
1. Introduction
These Terms and Conditions ("Terms") govern your use of services provided by Circle Connect (Pty) Ltd ("Circle Connect", "we", "us", or "our"), a wireless internet service provider operating in Mogale City, Krugersdorp, and surrounding areas in Gauteng, South Africa.
By subscribing to or using any of our services — including wireless internet, fibre, LTE, Khonecta Hotspot WiFi, VoIP telephone, security & CCTV, and IT support — you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Service Agreement
Upon registration and acceptance of these Terms, a service agreement is formed between you ("the Customer") and Circle Connect. This agreement commences on the date of activation and continues for the agreed contract period or on a month-to-month basis, depending on the selected package.
- Services are subject to coverage availability in your area.
- Installation dates are estimated and may vary due to technical or logistical factors.
- Equipment provided by Circle Connect remains the property of Circle Connect unless otherwise agreed in writing.
3. Acceptable Use
You agree to use our services responsibly and lawfully. The following activities are strictly prohibited:
- Using the service for any unlawful, fraudulent, or malicious activity.
- Distributing malware, viruses, or engaging in hacking or denial-of-service attacks.
- Reselling, redistributing, or sharing the service without prior written consent.
- Engaging in excessive bandwidth usage that negatively impacts other users on shared networks.
- Hosting servers or services on residential packages without authorisation.
Circle Connect reserves the right to suspend or terminate service without notice if a violation of this policy is detected.
4. Payment Terms
- All fees are payable in South African Rand (ZAR) and are due on the 1st of each month, in advance.
- Failure to pay within 7 days of the due date may result in temporary suspension of services.
- Accounts outstanding for more than 30 days may be handed over for collection, and the customer will be liable for all associated costs.
- Circle Connect reserves the right to adjust pricing with 30 days' written notice.
- Hotspot vouchers are prepaid and non-refundable once activated.
5. Installation & Equipment
- Installation is performed by Circle Connect technicians or authorised contractors.
- The customer must provide safe and reasonable access to the installation site.
- Equipment installed at the customer's premises (routers, antennas, ONTs) remains Circle Connect property unless purchased outright.
- Damage to equipment caused by the customer (including power surges, lightning, or misuse) will be repaired or replaced at the customer's expense.
- Upon termination, all Circle Connect equipment must be returned in good working condition within 14 days.
6. Service Levels & Availability
Circle Connect strives to maintain a high standard of service availability but does not guarantee uninterrupted service. Service may be affected by:
- Scheduled maintenance (customers will be notified in advance where possible).
- Force majeure events including power outages, severe weather, civil unrest, or natural disasters.
- Third-party network or infrastructure failures beyond our control.
Advertised speeds are "up to" speeds and may vary depending on network conditions, distance from the tower, number of concurrent users, and equipment used.
7. Cancellation & Termination
- Month-to-month services may be cancelled with 30 days' written notice.
- Fixed-term contracts are subject to early termination fees as specified in your service agreement.
- Circle Connect may terminate service immediately if these Terms are violated.
- All outstanding balances must be settled upon termination.
8. Limitation of Liability
To the maximum extent permitted by South African law, Circle Connect shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services, including but not limited to loss of data, loss of income, or business interruption.
Our total liability for any claim shall not exceed the amount paid by the customer for the service during the month in which the claim arose.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Gauteng, South Africa.
10. Changes to These Terms
Circle Connect reserves the right to amend these Terms at any time. Updated Terms will be published on this page, and continued use of our services constitutes acceptance of the revised Terms. Material changes will be communicated to active customers via email or WhatsApp.
